Dell seems immune to Nasdaq's deadlines and extensions to deadlines:

On 19 June, Dell failed once again to meet Nasdaq's reporting deadlines after it failed to publish its first quarter results on time. Under Nasdaq rules, delays automatically trigger a de-listing notice, but on 27 June, the Nasdaq Listing and Hearing Review Council gave Dell an extension until July 16 to get up-to-date with its filings, or see trading in its shares suspended.

This extension expired yesterday, with Dell once again failing to update its filings. Yet despite this lapse, it was revealed on Monday that the Nasdaq's board had decided to let Dell continue trading its stock on its exchange, pending a further review.

Once the golden child of the Nasdaq exchange, Dell has been struggling since this time last year to meet its regulatory deadlines.


Guess you've got someone who convinced Nasdaq that Nasdaq needs Dell more than Dell needs Nasdaq. Now if only you could show the same strength when dealing with Microsoft - Vista needs Dell more than Dell needs Vista too.

Idea - promote whomever you have negotiating with Nasdaq and put him in the position of negotiating with Microsoft to get out of their abusive (to your customers) terms in their contracts.

I mean no disrespect DELL, but what is the hold up on filling out the paperwork for NASDAQ ?

It would be beneficial to DELL to get these things in order, and put these stock related problems behind them, so Dell employees can focus on the customers.

Seems that depends on the nature of the problem.

If it's a really really bad problem perhaps delaying until some statue of limitations time period passes.

Perhaps the "The Sarbanes-Oxley Act of 2002 ... Section 804 -- Statute of Limitations for Securities Fraud ... 2 years ... 5 years" quote is relevant (from the link above):
